1. Introduction and Acceptance of Terms

These Terms of Service (the “Terms”) govern your access to and use of the products, services, website, communications, workshops, events, and related offerings provided by HarbourFold Origami Studio (“HarbourFold,” “we,” “us,” or “our”). By placing an order, booking a service, attending a workshop or event, accessing our website, or otherwise engaging our services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use our services or place any order. If you are entering into these Terms on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity.

2. Scope of Services

HarbourFold provides creative paper craft and origami-related services, which may include, without limitation:

  • Custom origami gift design;
  • Corporate workshop sessions;
  • Wedding and event decorations;
  • Personalized paper bouquet arrangements;
  • Origami party activities for children; and
  • Brand packaging inserts and paper accents.

Service descriptions, samples, quotations, timelines, and deliverables are provided for reference only and may be updated or modified based on design feasibility, material availability, production constraints, event requirements, and client instructions. Unless expressly agreed in writing, all services are bespoke and may vary from sample images or prior work.

We reserve the right to refuse any request that is unlawful, unsafe, defamatory, discriminatory, offensive, or otherwise inconsistent with our business values or operational capabilities.

3. User Obligations and Responsibilities

You agree to:

  • Provide accurate, complete, and current information when making inquiries, bookings, or orders;
  • Review quotations, proofs, mock-ups, schedules, and specifications carefully before approval;
  • Respond promptly to requests for confirmation, design approval, or additional information;
  • Ensure that any materials, logos, text, images, trademarks, or other content supplied to us do not infringe third-party rights;
  • Obtain all necessary permissions, consents, and licenses for any content you provide or request us to use;
  • Comply with all applicable laws, venue rules, safety instructions, and age-related supervision requirements;
  • Supervise children appropriately during children’s activities and workshops, where applicable;
  • Use our services and deliverables only for lawful purposes.

You are responsible for reviewing the suitability of our products and services for your intended purpose, including venue conditions, storage, display, handling, and transportation. Paper-based products are delicate and may be affected by humidity, heat, moisture, sunlight, and physical pressure.

You must not misuse our website, interfere with our systems, attempt unauthorized access, or use our services to transmit harmful, abusive, or infringing content.

4. Payment Terms and Conditions

All fees, deposits, taxes, delivery charges, setup charges, and other applicable costs will be communicated in our quotation, invoice, or booking confirmation. Unless otherwise stated, prices are quoted in Hong Kong Dollars (HKD).

  • A non-refundable deposit may be required to confirm a booking or commence design work or production.
  • Full payment may be required before delivery, event installation, workshop commencement, or collection.
  • For custom or time-sensitive orders, payment schedules may be staged according to project milestones.
  • Late payments may result in suspension of work, delayed delivery, cancellation of bookings, or additional administrative charges.
  • Any bank charges, payment processing fees, currency conversion fees, or similar charges are your responsibility unless otherwise agreed.

We may issue revised quotations if the scope changes, if additional materials are requested, or if there are changes in timing, venue, quantity, or specifications. Work will only proceed beyond the agreed scope upon our written confirmation.

Unless required by law or expressly stated otherwise, all payments are non-cashless and must be made using the methods accepted by us at the time of purchase.

5. Cancellation and Refund Policy

Because many of our services are custom-made, time-sensitive, or involve reserved production capacity, cancellations and refunds are subject to the following conditions unless a separate written agreement provides otherwise:

  • Deposits are generally non-refundable once design work, material procurement, or scheduling has commenced.
  • If you cancel a custom order after production has started, you may remain liable for all costs incurred up to the date of cancellation.
  • For workshops and event bookings, cancellation fees may apply depending on the notice period and any third-party costs already committed.
  • Where a cancellation is made by us due to safety, unlawful conduct, non-payment, or force majeure, we may offer a reschedule or a refund of amounts not already spent or committed, at our discretion and subject to applicable law.
  • Refunds, if approved, will be processed using the original payment method where reasonably practicable.

Any request for cancellation or refund must be submitted in writing to [email protected]. We may require supporting information, order details, and proof of payment before assessing the request.

Minor variations in color, texture, paper grain, hand-folding finish, dimensions, or presentation do not constitute defects and are inherent in handcrafted origami products.

6. Liability Limitations

To the fullest extent permitted by the laws of Hong Kong, HarbourFold shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary losses, including loss of profit, loss of business, loss of goodwill, loss of opportunity, or loss arising from delays, except where such liability cannot be excluded by law.

Our total aggregate liability arising out of or in connection with any service, order, workshop, event, or product shall be limited to the amount actually paid by you to us for the specific service giving rise to the claim, except where such limitation is prohibited by law.

We are not responsible for:

  • Damage caused by improper handling, storage, installation, transport, or display after delivery;
  • Delays caused by third-party couriers, venues, suppliers, or event operators;
  • Errors or omissions in content supplied by you;
  • Losses caused by inaccurate instructions, late approvals, or changes requested by you;
  • Allergic reactions, injuries, or incidents arising from misuse, lack of supervision, or failure to follow safety instructions;
  • Damage caused by environmental conditions such as humidity, water, heat, or direct sunlight.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

7. Intellectual Property Rights

Unless otherwise agreed in writing, all intellectual property rights in our designs, concepts, templates, sketches, prototypes, methods, workshop materials, photographs, videos, branding, and website content remain the property of HarbourFold or our licensors.

Upon full payment, you receive a limited, non-exclusive, non-transferable license to use the final deliverables solely for the purpose agreed in the relevant order or contract. You may not reproduce, resell, distribute, adapt, publish, or create derivative works from our materials without our prior written consent.

We may, unless you object in writing, photograph or record completed works for portfolio, promotional, archival, or marketing purposes, provided that any use of your name, logo, event details, or images is subject to applicable privacy obligations and any separate confidentiality agreement.

If you provide us with logos, trademarks, artwork, or other materials, you grant us a non-exclusive license to use them solely for the purpose of fulfilling your order or booking.

8. Data Protection and Privacy

We collect, use, store, and process personal data only as necessary to provide our services, manage bookings, process payments, communicate with you, comply with legal obligations, and improve our operations. We will handle personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong and any other applicable laws.

Personal data may include your name, contact details, billing information, event details, preferences, and correspondence.

We may disclose personal data to:

  • Payment processors, banks, and financial institutions;
  • Delivery providers, couriers, and logistics partners;
  • Venue operators, event coordinators, or workshop assistants where necessary;
  • Professional advisers, insurers, and regulators where required;
  • Any other party with your consent or as required by law.

You are responsible for ensuring that any personal data you provide about third parties, including guests, children, or event attendees, is shared lawfully and with appropriate consent where required.

We take reasonable administrative, technical, and physical measures to protect personal data, but no method of transmission or storage is completely secure. By using our services, you acknowledge this risk.

9. Force Majeure

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to acts of God, fire, flood, typhoon, storm, epidemic, pandemic, public health emergency, war, civil unrest, terrorism, labor disputes, power failure, supply shortages, transport disruption, government action, or failure of third-party services.

In the event of force majeure, we may suspend performance, extend timelines, substitute materials, reschedule services, or cancel affected services where reasonably necessary. We will use reasonable efforts to notify you and minimize disruption.

10. Changes to Terms

We may update or revise these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The revised Terms will take effect upon posting or upon notice to you, as applicable.

Your continued use of our services after any change constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must discontinue use of our services and, where applicable, cancel any future bookings subject to the cancellation policy.

11. Applicable Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.

You agree that the courts of Hong Kong shall have exclusive jurisdiction to settle any dispute, claim, or controversy arising out of or in connection with these Terms, your use of our services, or any related matter, subject to any mandatory legal rights or remedies available under applicable law.

13. Severability Clause

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or competent authority, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Where possible, any invalid or unenforceable provision shall be replaced with a valid provision that most closely reflects the original intent and commercial purpose of the affected provision.
